TDIU vocational assessments for VA individual unemployability claims
Total Disability based on Individual Unemployability (TDIU) pays at the 100 percent rate when service-connected disabilities prevent a veteran from working, even if the combined rating is lower. Whether that is true is a vocational question, and it deserves vocational evidence.
Overview
The vocational question at the center of a TDIU claim
Under 38 C.F.R. § 4.16(a), a veteran generally qualifies for TDIU consideration with one service-connected disability rated at 60 percent or more, or two or more with at least one at 40 percent and a combined rating of 70 percent or more. When those thresholds are not met, § 4.16(b) allows extraschedular consideration.
Either way, the decision turns on one question: are the veteran's service-connected disabilities, considering education and work history, sufficient to prevent substantially gainful employment? Marginal employment, such as earnings below the poverty threshold, does not count as substantially gainful.
Medical evidence describes limitations. A vocational assessment explains what those limitations mean for real jobs, using the veteran's work history, transferable skills, and the demands of the occupations that remain.

Vocational evidence, not a form letter
A statement that a veteran "cannot work" carries little weight on its own. An assessment that walks through the veteran's history, the functional limits in the record, and the work those limits rule out gives an adjudicator something to rely on.
We stay in the evidence lane. We do not provide legal advice, represent claimants, or promise outcomes.
